Basically the same as Governor Cuomo. Molinaro's concern is that third term abortions might be illegal if Roe v. Wade reversed. So, no one to vote for, for NY Governor. Advocates say state law currently falls short of the protections provided by Roe and subsequent court decisions. They note that that under current New York law, abortion is a criminal act unless it's performed before the 24th week of pregnancy, or is necessary to preserve a woman's life. The Reproductive Health Act would repeal that section of the penal law and create a new, non-criminal section of the Public Health Law.
"I understand the need, should the Supreme Court suggest that [abortion is] not a constitutional right – and it is," Molinaro said on Wednesday. "Should the Supreme Court suggest it's not a constitutional right, the state would need to act, to at least codify, so that it's not treated as a criminal or penal violation."

"They disagree with me on lots of things, and they're still putting out ads [for me]," Molinaro said Wednesday. "I do believe it is a settled constitutional right. I don't have to agree with it. But I do agree it is a settled constitutional right, and therefore I would defend it as governor."
